All property, real and personal, so devised, bequeathed, given, granted, released, conveyed, or appointed, or declared or directed to be held upon trust, shall, subject to "The Methodist Church Property Acts, 1893-1905," and to the trusts declared in such will, deed, or other document, and subject to any directions to the contrary therein contained so far as the same are capable of taking effect, be under the direction and control of the Queensland Conference.

9. All personal property in Queensland to which the Uniting Churches, or either of them, or any corporation, fund, institution, society, or auxiliary of the Uniting Churches, or either of them, is entitled at the passing of this Act, and all personal property to which the Methodist Church of Australasia, the Queensland Conference, or any fund, institution, society, or auxiliary of such Church, is at the passing of this Act or may hereafter from time to time become entitled, is hereby vested or shall vest, as the case may be, in the trustees appointed for the time being under "The Methodist Church Property Acts, 1893-1905," of the lands or premises whereon or wherein such personal property may be or in connection with which the same may be used, or if there are no such trustees then in the president for the time being of the Queensland Conference and his successors in office, and shall be held by such trustees or by such president or by his said successors in trust for the Methodist Church of Australasia upon such trusts and for such purposes as shall from time to time be declared or directed by the Queensland Conference.

10. (1.) When and so often as the Queensland Conference duly alterations to exercises its power to alter or modify the Model Deed, a copy thereof, showing such alterations or modifications, and certified by and under the hand of the president for the time being of the Queensland Conference, shall, with all reasonable despatch, be lodged and enrolled in the office of the Registrar of Titles of Queensland; and then, and not till then, the alterations and modifications shall be deemed to have been made in the Model Deed.

(2.) A revised Model Deed, showing all alterations and modifications authorised up to the date of such revision, may from time to time be prepared and adopted by the Queensland Conference, and shall, after being certified under the hand of the president of the said Conference, and lodged and enrolled in the office of such Registrar of Titles, be intituled The Methodist Model Deed of Queensland," and shall thereafter be the Model Deed for all purposes under "The Methodist Church Property Acts, 1893-1905," in lieu of the Model Deed superseded thereby.

11. Nothing in this Act shall limit, restrict, take away, or alter any rights or powers which any trustee of real or personal property by this Act directed to be held in trust for the Methodist Church of Australasia, or any fund, institution, society, or auxiliary thereof, had or possessed prior to the passing of this Act to sell or mortgage or be indemnified out of such property in order to liquidate any debts or obligations properly incurred by or resting upon him in respect of such property. 12.*

15. (1.) (2.) PART I.

The first column shows the locality in which the Church lands are situated; the second column shows the nature of the title, whether deed of grant, certificate of title, or conveyance; and the third column shows, in cases of deeds of grant and certificates of title, respectively, the number, volume, and folio in the Register Book in the office of the Registrar of Titles; and, in cases of conveyances registered in the Registrar of Titles' Office, such third column shows the number of each memorial and book which deeds of grant, certificates of title, and conveyances respectively contain a description of the lands respectively therein comprised. In all cases where the volume and folio are given, the lands are under the provisions of the Real Property Act of 1861 "t; in all other cases, under the general law.

THE WARWICK CHAPEL LANDS SALE ACT OF 1874. An Act to enable the Trustees of three Allotments of Land in the Town of Warwick granted for the purposes of the religious body called Methodists to sell the same and to devote the proceeds to the building of a Chapel on other land in a more convenient situation.

WHEREAS by a deed of grant under the hand of His Excellency The Preamble.

Honourable Maurice Charles O'Connell the officer administering the Government of the Colony of Queensland and the seal of the said colony dated the thirtieth day of July one thousand eight hundred and sixty-eight and numbered 18911 a certain piece of land therein described and containing by admeasurement one acre more or less situated in the county of Merivale parish of Warwick town of Warwick was granted by Her Majesty unto John Sargeant Turner James Sutherland and Charles Milne Foster upon trust for the appropriation thereof as a site of a chapel for the use of the people called Methodists in the connection established by the late Reverend John Wesley and for no other purpose whatsoever And whereas by another deed of grant under the hand of His said Excellency and the seal of the said colony dated the said thirtieth day of July one thousand eight hundred and sixty-eight and numbered 18912 a certain other piece of land therein described and containing by admeasurement two roods more or less situated in the said county of Merivale parish of Warwick and town of Warwick was granted unto the said John Sargeant Turner James Sutherland and Charles Milne Foster

upon trust for the appropriation thereof as a site of a schoolhouse for the use of the said people called Methodists in the connection established by the late Reverend John Wesley and for no other purpose whatsoever And whereas by another deed of grant under the hand of His said Excellency and the seal of the said colony dated the said thirtieth day of July one thousand eight hundred and sixty-eight and numbered 18913 a certain other piece of land therein described and containing two roods more or less situated in the said county of Merivale parish of Warwick and town of Warwick was granted unto the said John Sargeant Turner James Sutherland and Charles Milne Foster upon trust for the appropriation thereof as a site of a dwelling house garden and other appurtenances for the Minister duly appointed to officiate in the chapel in the use of the said people called Methodists in the connection established by the late Reverend John Wesley erected at Warwick and for no other purpose whatsoever And whereas it is expedient that the said trustees should be empowered to sell and dispose of the whole of the said lands and to use the proceeds of such sale for the erection of a chapel on another more convenient portion of land within the county parish and town aforesaid Be it enacted by the Queen's Most Excellent Majesty with the advice and consent of the Legislative Council and Legislative Assembly of Queensland in Parliament assembled and by the authority of the same as follows— 1. The said trustees or their successors shall be empowered at any empowered to time after the passing of this Act to sell the three several parcels of land situated in the county of Merivale parish of Warwick and town of Warwick described respectively in the deeds of grant numbered 18911 18912 and 18913 and containing respectively one acre two roods and two roods by public auction and not otherwise due notice of which shall be given in one or more of the Warwick newspapers at least one fortnight before the day on which the said parcels of land will be offered for sale and the highest bidder shall be the purchaser and on payment of the purchase money into the hands of the said trustees or their successors they shall convey the lands as aforesaid to the purchaser and such conveyance shall be valid and effectual in law and equity for all purposes whatsoever anything contained in " The Trustees of Public Lands Act of 1869" to the contrary notwithstanding.

2. Immediately after the receipt of the moneys realized by the sale of the lands the said trustees or their successors shall pay the reasonable expenses of such sale and shall deposit the remainder of the purchase moneys in the Government Savings Bank and shall not withdraw the same or apply any part thereof for any purpose except for the payment of labor done or material actually supplied for the erection on the land comprised within section number twenty-one being allotments number one and number twenty of the aforesaid section county of Merivale parish of Warwick and town of Warwick of a chapel for the use of the people called Methodists in the connection established by the late Reverend John Wesley.

3. This Act may be cited as "The Warwick Chapel Lands Sale Act of 1874."
