That where, by the law of God, and the laws of this and every other well governed realm, murder, or the felonioufly bereaving any of his Majefiy's (ubjeas of their lives, is a mod: atrocious crime, and (everely puniihable; yet true IT is, and of verity, that you, the (aid Mungo Campbell, have 'pre(umed to commit, and are guilty, actor, or art and part of the (aid crime; IN SO far AS the deceafed Alexander earl of Eglintouh having, upon the twenty - fourth day of Oétober, in this prefent year one thoufand (even hundred and fixty-nine, or upon one or Other of the days of that month, or of the month of September preceding, 'or November following, gone out from his houfe of Eglintoun, in the county of Air, in his coach, to look at (ome of his grounds, and being told by one of his (ervants, when upon the road from Saltcoats to Southennan, within the panih of Ardroll'an, and (aid county of Air, that he obferved two per(ons, one of them with a gun, at a (mall difiance, upon his dordlhip's ground of Ardrofi'an, the (aid decea(ed earl (who, by an adverti(ement in the news-papers, had forbid all unqualified perfons to kill game within his efiate) came out of his coach, unarmed, and mounted a botfa which was led by his (errant, and, leaving in his coach an unloaded gun, he rode towards the two per(ons, who, in the mean time, went off the earl's grounds of Ardro'fl'an into the adjacent (ands, and be having come near to the two perfons on the (aid (ands, and difcovering the one with the gun to be you, the (aid Mungo Campbell, he accofied you, by faying, Mr. Campbell, I did not expect to have found you (0 (con upon my grounds, after the. Promife you made me when Ilait catched you, when you had (hot a hare; and the earl having thereupon defired you to deliveryour gun to him, you refuted (o to do; and, upon the earl's approaching towards you, you cocked your gun, and prefented or pointed it at him: and upon the earl's then (aying, Sir, will on (hoot me?
